ATG Bakersfield Limited Warranty

This Limited Warranty is provided by ATG Bakersfield, 720 Roberts Ln, Bakersfield, California 93308. Questions and warranty claims may be sent to atgbakersfield@gmail.com.

1. Products and warranty periods

The applicable warranty begins on the date the product is delivered to the customer or picked up from ATG Bakersfield:

  • ATG-rebuilt units: 1 year.
  • ATG-refurbished units: 90 calendar days.
  • Used units: 30 calendar days.
  • New or manufacturer-remanufactured products: the manufacturer's written warranty, if any, applies according to its terms. The product listing, packaging, invoice, or manufacturer warranty document identifies the applicable coverage. ATG Bakersfield does not shorten a manufacturer's written warranty or any nonwaivable right provided by law.

If the product listing or invoice expressly provides a longer written warranty, the longer stated period applies. For California used consumer goods sold with an express warranty, applicable implied warranties apply for the period required by law. These time periods do not limit any right that cannot lawfully be waived.

2. What this limited warranty covers

For the applicable period, ATG Bakersfield warrants covered ATG-rebuilt, ATG-refurbished, and used units against defects in materials or workmanship under normal, intended use. Coverage is extended to the original retail purchaser and to any other person entitled to enforce the warranty under applicable law.

3. Warranty remedy

After receiving a timely claim and a reasonable opportunity to inspect the product, ATG Bakersfield will repair the covered product, replace it with an identical or reasonably comparable product, or, when repair or replacement cannot be provided within a reasonable time, provide a refund or other remedy required by applicable law.

For covered California consumer goods, warranty service will begin within a reasonable time and will ordinarily be completed within 30 days, unless the customer agrees otherwise in writing or applicable law permits additional time. The warranty period will be extended or tolled while a qualifying product is in authorized warranty service when required by law.

4. How to obtain warranty service

  1. Stop using the product if continued operation could cause additional damage or create a safety risk.
  2. Contact ATG Bakersfield at atgbakersfield@gmail.com or at 720 Roberts Ln, Bakersfield, CA 93308 before disassembly, outside repair, or return shipment.
  3. Provide proof of purchase; the product, part, serial, and model numbers; vehicle VIN and application; delivery or pickup date; installation date and mileage, if applicable; symptoms and diagnostic codes; and reasonably requested photographs, installation records, lubricant specifications, and maintenance records relevant to the claimed failure.
  4. Follow the return, inspection, and transportation instructions provided with the return authorization. Do not authorize outside repairs or teardown at ATG Bakersfield's expense unless ATG Bakersfield approves them in writing.

For a voluntary return, transportation is governed by the Return and Refund Policy. For a valid warranty claim involving a California consumer good that cannot reasonably be returned because of its size, weight, installation, or condition, ATG Bakersfield will arrange and pay reasonable transportation when required by law.

5. Exclusions

This limited warranty does not cover a failure to the extent it was caused by:

  • normal wear, routine maintenance, or consumable materials;
  • an incorrect application or inaccurate fitment information supplied by the customer, except where ATG Bakersfield supplied the wrong item or made the fitment error;
  • improper installation, adjustment, calibration, programming, break-in, maintenance, storage, or transportation;
  • contamination, use of an incorrect or insufficient lubricant or fluid, overheating, overloading, operation beyond published ratings, abuse, neglect, collision, fire, water intrusion, racing, or other unauthorized or unreasonable use;
  • unauthorized modification, disassembly, teardown, or repair; or
  • continued operation after a warning, malfunction, loss of lubricant, or other condition that reasonably should have prompted the operator to stop.

An exclusion applies only to the extent the excluded condition caused or contributed to the claimed failure. Electronic products that are final sale for ordinary returns remain eligible for any applicable written warranty and for remedies required by law.

6. Costs not covered

Unless ATG Bakersfield authorizes them in writing or applicable law requires otherwise, this limited warranty does not pay for unauthorized outside labor, diagnostics, teardown, towing, travel, lodging, rental vehicles, loss of use, downtime, lost revenue, lost profits, or other incidental or consequential losses. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

7. Other legal rights

This warranty gives you specific legal rights, and you may also have other rights which vary from State to State. Nothing in this warranty excludes, limits, or delays a remedy that cannot be excluded, limited, or delayed under California or federal law.
